Client terms
These are the plain-English terms for my monthly website plans. By paying for a plan, you agree to them.
1. What you get
I design and build a custom website for your business, host it, keep it secure and backed up, and make changes for you each month, as described in the plan you choose. Every plan includes a short monthly report.
2. Payment
- Plans are billed monthly in advance, by card through Stripe, starting on the day you sign up.
- All prices are in NZD. I'm not currently GST registered, so no GST is added.
- Founding-client rates stay the same for as long as you stay on your plan.
- If a payment fails, I'll let you know. If it's still unpaid after 14 days, I may take the site offline until it's sorted.
3. Minimum term and cancelling
- There's a 6-month minimum, because your site is designed from scratch.
- After 6 months it's month to month. Cancel any time with an email; your plan ends at the end of the month you've paid for.
- If you cancel during the first 6 months, the remaining months of the minimum are still payable.
4. Changes each month
Your plan includes a set amount of changes each month, such as updated hours, prices, photos or text. Unused time doesn't roll over. New pages or bigger features beyond your plan are quoted separately before I start.
5. What I need from you
Your business details, logo, photos and any text you'd like used. You confirm you have the right to use anything you send me. Delays in getting these to me may delay your launch.
6. Who owns what
- Your domain name is registered in your name and is always yours.
- Your content (text, photos, logo) is always yours.
- While you're on a plan, the site design and code are licensed to you. If you leave after the minimum term, you can buy the site outright for a one-off fee so you can host it elsewhere, or simply take your content and domain with you.
7. Photo sessions
Photo sessions are an optional extra, paid separately. Photos are yours to use on your website and social media. Sessions are in the Waikato; travel further afield is by arrangement.
8. Uptime and liability
I use reliable hosting and do my best to keep your site online and working, but I can't guarantee it will never go down. My liability for any problem is limited to the amount you've paid me in the previous 3 months. Nothing in these terms limits your rights under the Consumer Guarantees Act where it applies.
9. Privacy
I only use your details and your customers' enquiries to run your website and plan. I don't sell or share them.
10. Changes to these terms
If I change these terms, I'll tell you by email at least 30 days before the change applies.
